Terms of Service

Agreement

By engaging Creative Wave Media for any project or service, you agree to these terms. Creative Wave Media is operated by Oscar Searle, based in Wānaka, New Zealand. The full scope, deliverables and timeline for each project are agreed upon in writing before work begins.

Payment

An invoice will be issued on the day of the shoot or once the final deliverable has been delivered. Unless otherwise agreed in writing:

  • Payment is due within 14 days of the issued invoice
  • Payment can be made via bank transfer, with details included on the invoice
  • Payment may also be made on the day of the shoot if preferred
  • All prices are in NZD

Delivery

All content will be delivered digitally via a downloadable link, usually through Frame.io, making it easy for the client to access and download files.

If the client prefers content delivered on a hard drive, this can be arranged for an additional charge to cover the cost of the drive and preparation.

Delivery timelines will be communicated in advance and Creative Wave Media will make every effort to provide content promptly.

Usage Rights & Copyright

The client is granted full usage rights for all content produced under their agreement. This includes the right to use the content across digital platforms such as social media, websites and online advertising, in accordance with the scope of the project.

Creative Wave Media retains full copyright ownership of all content created. This allows Creative Wave Media to use the content for portfolio purposes and promotion on its own social media platforms. This also includes behind-the-scenes content and other materials generated during the project.

The client may not resell, licence, or redistribute the content outside the agreed usage without prior written consent from Creative Wave Media.

Cancellation Policy

If the client cancels or reschedules the shoot less than 48 hours before the scheduled time, a cancellation fee of $100 NZD will apply.

If the shoot is rescheduled, the client will have the opportunity to select a new date, subject to availability.

If Creative Wave Media is unable to attend the shoot for any reason, every effort will be made to reschedule. If rescheduling is not possible, any deposits or related costs paid by the client will be refunded in full.

Approval Process

The client will have five (5) business days to review the final content upon delivery. Any revision requests or additional feedback must be submitted within this period. After this time, further revisions may incur additional charges at Creative Wave Media's standard hourly rate.

Amendments

The client may request amendments to their agreement; however, all requests must be made at least 24 hours prior to the scheduled shoot date. Any agreed-upon changes must be documented in writing and signed by both parties before the shoot proceeds.

Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be resolved in the New Zealand courts.
